New Jersey Divorce Lawyers

Mediation is growing in popularity for resolving all sorts of business and personal disputes in an out-of-court setting.  When a divorcing couple realizes just how expensive a court battle will be, many opt to work out their differences at the mediation table rather than have a judge impose a solution on them. At Adinolfi & Packman, P.A., we are pleased to have retired Judge Joseph Testa on staff to assist our clients who chose to use mediation to resolved their divorce matter.  Judge Testa (Ret) has more than 40 years of Family Law experience including more than a decade of experience sitting on the bench in Family Court in New Jersey.

Mediation is a method of alternative dispute resolution whereby a neutral third party facilitates a mutually acceptable resolution between the parties.  The mediator does not make any decisions, but rather serves only to facilitate the parties to arrive at their own agreement in a non-adversarial environment.  The parties decide the terms and fairness of their own agreement with or without independent advice from their attorneys.  Both parties typically share the cost of the New Jersey divorce mediator.

The benefits of New Jersey divorce mediation

Rather than paying divorce lawyers to stand around at the courthouse waiting for your hearing to begin, mediation offers couples the flexibility to schedule meetings at convenient times and places with or without the input of lawyers.  Also, instead of a public court battle that leaves only bitterness and resentment in its wake, mediation moves the dispute to a far less contentious atmosphere.  This preserves a healthy relationship between ex-spouses beyond the divorce so they can coparent their children and share in their special milestones and life events.

To successfully reach mutual agreement, couples using mediation must be able to make compromises, share information willingly, and fully cooperate with each other.  If one or both spouses are unwilling to yield on one or more key issues, their dispute may need to start over in divorce court.

Also, if either party must seek a court-enforced order of protection against abuse or to ensure financial disclosures through discovery, then traditional divorce court may be their better course of action.  Adinolfi & Packman, P.A.  has lawyers who are well-experienced regarding the issues of domestic violence that come up in the course of contentious divorce and family law litigation.  The firm is uniquely positioned to handle matters in which domestic violence becomes an issue.
